1. INTRODUCTION
Please read the below-mentioned terms and conditions carefully. They constitute an integral part of the Participant Agreement for the event, and by ticking the acceptance box and proceeding to payment you agree to be bound by them (see Clause 16). All hiking, trekking, camping, nature walks, outdoor learning activities, and adventure programs organized under the “Hiking Cubs” vertical are jointly operated by Jungle Cubs and Hiking Cubs (each and collectively hereinafter referred to as “the Company”, which expression shall, unless repugnant to the context, include its partners, proprietors, employees, coaches, guides, volunteers, representatives, and associated persons), and shall be governed by the following terms and conditions.
2. REGISTRATION & BOOKING
2.1 Registration may be completed through the Company’s office, website, schools, authorized representatives, or partner institutions.
2.2 The parent or legal guardian shall provide accurate personal, medical, and emergency information in respect of the participant and of any accompanying family member(s).
2.3 The Company reserves the right to accept or reject any registration without assigning any reason.
2.4 Parents/guardians shall immediately inform the Company regarding any changes in medical condition or emergency contact details.
3. PARTICIPATION REQUIREMENTS
3.1 Participants, and any accompanying family member(s), must be physically and medically fit to undertake the trek/activity.
3.2 Parents/guardians must disclose any medical condition, allergy, medication, disability, behavioural concern, or special requirement affecting the participant or any accompanying family member.
3.3 Failure to disclose such information may result in exclusion from the activity without refund.
3.4 The Company reserves the right to refuse participation to any person, including an accompanying family member, considered medically unfit or a safety risk.
3.5 By registering, the parent/guardian certifies that the participant and all accompanying family members are physically fit and capable of participating in the outdoor adventure, and undertakes that they shall strictly follow the safety guidelines and instructions issued by the trek hosts/guides at all times.
3.6 Where the participant or any accompanying family member has any medical condition (including but not limited to any condition relating to bones, joints, or the heart, or any other medical condition), the parent/guardian shall disclose the same to the Company's trek leader, either via the official trek WhatsApp group or by a personal message to the trek leader, prior to the trek.
3.7 Upon disclosure of any medical condition under Clause 3.6, the trek leader shall require the parent/guardian to obtain and furnish a fitness certificate from a registered medical practitioner confirming that the concerned person is fit to undertake the trek.
3.8 Where the trek leader has specifically requested disclosure of any medical condition, whether prior to the trek or at the commencement of the trek, and the parent/guardian fails to disclose an existing medical condition of the participant or any accompanying family member when so asked, the Company shall not be liable for any injury or medical complication suffered by such person arising from or connected to the undisclosed medical condition.
3.9 Notwithstanding the furnishing of a fitness certificate under Clause 3.7, the trek leader may conduct such basic tests or consultation with the concerned person as the trek leader considers necessary for additional confirmation of fitness. Where, based on such test or consultation, the concerned person is not confident of participating, or does not clear such test, but the parent/guardian nevertheless wishes for such person to proceed with the trek, the Company shall provide a separate consent form, which the parent/guardian must sign prior to participation, and such participation shall thereafter be entirely at the risk of the concerned person in accordance with such consent form.
3.10 Where a parent/guardian, while registering on the Company's website/app, fails to disclose or fill in any medical condition of the participant or any accompanying family member in the fields provided for the same (which are mandatory), and any injury occurs during the trek in connection with such undisclosed medical condition, the Company shall not be liable for the same.
4. ASSUMPTION OF RISK
The parent or guardian acknowledges that the hiking, trekking, camping, transportation, and outdoor activities — including outdoor trails, streams, and waterfalls — involve inherent risks, including but not limited to:
- Slips and falls
- Minor or major injuries
- Unpredictable weather conditions
- Rough or slippery terrain, including wet rocks
- Insect, animal, or wildlife encounters
- Transportation incidents
- Natural hazards
- Illness or medical emergencies
- Acts of nature
- Loss of or damage to personal belongings
Participation is voluntary and entirely at the participant’s (and any accompanying family member’s) own risk. By registering, the parent/guardian voluntarily assumes all such risks on their own behalf and on behalf of the participant.
4.1 Trail Deviation: Where a marked or designated trail is being followed during a Hiking Cubs trek, and any parent, child, or accompanying adult deviates from or fails to follow such trail, the Company shall bear no responsibility or liability whatsoever for any injury, accident, or loss arising therefrom, and no medical or other expenses in connection with such injury shall be borne by the Company.
4.2 Stream Crossing: Where, during a trek, the Company’s guides/educators determine that a stream crossing is unsafe on account of weather or water conditions and accordingly decide, and communicate to the group, that the stream shall not be crossed, and any parent, guardian, or adult participant nevertheless chooses to cross the stream against such communicated decision, the Company shall bear no responsibility or liability whatsoever for any injury, accident, loss, or death arising therefrom, and no medical or other expenses in connection therewith shall be borne by the Company, it being expressly acknowledged that such person shall have acted contrary to the Company’s express instruction and entirely at their own risk.
5. MEDICAL TREATMENT & EMERGENCY EVACUATION
5.1 The Company may provide basic first aid.
5.2 In case of emergency, the Company may arrange medical treatment, hospitalization, or evacuation.
5.3 All expenses relating to transportation, ambulance, hospitalization, medicines, evacuation, or treatment shall be borne solely by the parent or guardian (or, in the case of an adult participant, by that adult).
5.4 The Company shall not be liable for medical complications arising during or after the activity.
5.5 Cost of Treatment and Assistance: If any injury is sustained by any person (adult or child) during the trek, the medical treatment charges arising therefrom shall be borne solely by the concerned parent/guardian or adult. Where the Company’s educators, guides, or team members are required to assist or escort the injured person back to the camp/hotel from the trek location, the Company shall be entitled to charge the concerned parent/guardian or adult for such additional assistance/hospitality, and the same shall be payable on demand.
5.6 Medical Consent Authorisation: The parent/guardian hereby expressly authorises the Company, its guides, coaches, and staff to administer basic first aid to the participant and to arrange for such medical treatment, hospitalization, or evacuation as may, in their reasonable judgment, be considered necessary in the event of an emergency, without any requirement to obtain the parent/guardian’s prior consent for each such instance. This authorisation is without prejudice to Clauses 5.1 to 5.5 above, which shall continue to govern the extent of the Company’s obligations and the participant’s liability for costs in this regard.
6. TRANSPORTATION
Transportation services, if provided, are operated by third-party vendors. The Company shall not be responsible for delays, traffic conditions, mechanical failures, or circumstances beyond its control. All participants must follow safety instructions during travel.
7. LEADER AUTHORITY & CONDUCT
Participants and accompanying family members shall obey all instructions issued by coaches, leaders, and organizers at all times. The Company reserves the right to suspend or remove any participant or accompanying family member whose conduct:
- Endangers safety.
- Disrupts activities.
- Damages property.
- Creates inconvenience for others.
No refund shall be provided in such cases.
7.1 Conduct: Without prejudice to the foregoing, no participant or accompanying family member shall consume alcohol, smoke, or use any recreational drugs during the trek/activity, including at the basecamp, campsite, or any Company premises, and no such person shall engage in any sexual misconduct or any physical or verbal aggression (including but not limited to abusive language, threats, shouting, or physically pushing or shoving) towards fellow participants, accompanying family members, Company staff, guides, or any other person. Any participant or accompanying family member found in violation of this Clause 7.1 shall be liable to have their participation in the trek/activity immediately suspended or terminated by the Company.
7.2 Cost of Return on Removal: Where a participant’s or accompanying family member’s presence on the trek/activity is suspended or terminated under Clause 7.1 or otherwise for conduct described in this Clause 7, no refund shall be payable, and the concerned parent/guardian shall bear the entire cost of the transport, guide, or escort required to return the concerned person to the base camp/hotel or point of origin.
8. PHOTOGRAPHY & MEDIA CONSENT
The parent or guardian grants permission to the Company to use photographs, videos, recordings, and other media for:
- Educational purposes
- Marketing
- Social media
- Advertising
- Promotional materials
No compensation shall be payable for such usage.
9. CANCELLATION & REFUND POLICY
9.1 Trek/event fees, once booked, are non-refundable and non-transferable, save as expressly provided in Clause 10.1 below (25% refund on Company-initiated cancellation due to weather or natural calamities/force majeure reasons, prior to commencement of the trek), Clause 10.2 below (full 100% refund where the Company cancels for reasons personal or internal to it), and Clause 10.3 below (no refund where the Company cancels or discontinues the trek due to weather or natural calamities/force majeure reasons after commencement of the trek). No carry-forward of fees applies under any of Clauses 10.1, 10.2, or 10.3.
9.2 Cancellations or missed bookings on account of illness or any other personal reason shall not be refunded, and shall not be adjusted against regular Jungle Cubs class fees or any other fees payable to the Company.
9.3 No refund or rescheduling shall be provided in case of:
- Non-attendance.
- Late arrival.
- Early departure.
- Participant withdrawal.
- Violation of rules.
9.4 Food & Catering: The number of meals/food served during a trek/event is fixed and confirmed by the Company with its food caterers 24 (twenty-four) hours in advance, based strictly on the number of registered and paid participants. If any driver or other accompanying person who is not a registered participant consumes the food/meals arranged for registered participants without the Company’s prior authorization, such driver/accompanying person (or the participant they are accompanying) shall be liable to pay the full trek/event fee applicable to a participant, irrespective of whether such driver/accompanying person actually undertakes the trek/activity.
10. FORCE MAJEURE
The Company reserves the right to postpone, modify, reschedule, or cancel an event due to:
- Weather conditions
- Natural disasters
- Government restrictions
- Road conditions
- Safety concerns
- Public health emergencies
- Circumstances beyond reasonable control
In such cases, the Company’s decision shall be final.
10.1 Where a trek/event is canceled by the Company on account of weather conditions or other natural calamities/force majeure reasons under this Clause 10, prior to commencement of the trek (as defined in Clause 10.3 below), the Company shall refund 25% (twenty-five percent) of the amount paid by the participant for such trek/event. No carry-forward of the amount paid, in whole or in part, shall be available in such cases.
10.2 Where a trek/event is canceled by the Company for reasons personal or internal to the Company (i.e., reasons other than weather, natural calamities, or the other force majeure grounds set out in this Clause 10), the Company shall refund the full (100%) amount paid by the participant for such trek/event. No carry-forward shall apply in such cases, the amount being refunded in full.
10.3 Where a trek/event is canceled or discontinued by the Company on account of weather conditions or other natural/force majeure reasons after commencement of the trek — that is, after the participants have had breakfast and reported/assembled at the trek starting point or trail entrance for the day — no refund or carry-forward shall be available, and the full trek/event fee shall stand forfeited to the Company. This is because the Company would, by that stage, have already incurred costs towards educators/guides, breakfast, lunch, and other logistics arranged for the day, irrespective of whether the trek is subsequently completed.
11. LIABILITY WAIVER & INDEMNITY
The parent or legal guardian hereby releases, indemnifies, and holds harmless Jungle Cubs, Hiking Cubs, and their respective partners, employees, coaches, guides, volunteers, representatives, schools, venues, transport providers, and associated persons from any and all claims, damages, injuries, disabilities, losses (including loss of or damage to personal belongings), medical expenses, and legal proceedings arising directly or indirectly out of participation in the activity, except in cases of proven wilful negligence on the part of the Company. Neither the participant, any accompanying family member, nor their respective legal heirs shall make any claim against the Company save as aforesaid.
11.1 Indemnity: In addition to the release set out above, the parent/guardian hereby agrees to indemnify, defend, and hold harmless the Company against any claim, action, or demand made by any third party, including any other participant, arising out of or in connection with any act, omission, or conduct of the participant or any accompanying family member during the trek/activity.
12. PRIVACY POLICY
Participant information shall be used only for registration, safety, emergency, operational, and communication purposes. The Company may share necessary information with medical personnel, emergency services, transport operators, or authorities whenever required.
13. LAW & JURISDICTION
This agreement shall be governed by the laws of India. Any dispute arising out of this agreement shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
14. SEVERABILITY
If any provision of this agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed from this agreement, and the remaining provisions shall continue in full force and effect.
15. RELIANCE ON AGREEMENT
The parent/guardian acknowledges that, in determining and offering the fee charged for the trek/event, the Company has relied on the parent/guardian’s agreement to be bound by the terms of this Participant Agreement, and that the Company would not be able to offer its services on the same terms without such agreement.
16. ELECTRONIC ACCEPTANCE
16.1 This Participant Agreement is entered into in electronic form. The parent/guardian accepts it, on their own behalf and on behalf of the participant and any accompanying family member(s), by ticking the acceptance box on the Company’s website/app and proceeding to payment. Such acceptance shall be a valid and binding acceptance of this Agreement, having the same force and effect as a signature, and no physical signature shall be required, save for the separate consent form referred to in Clause 3.9.
16.2 The Company may maintain an electronic record of such acceptance, including the date and time of acceptance and the booking to which it relates.
17. ACKNOWLEDGEMENT & DECLARATION
By ticking the acceptance box and proceeding to payment, I, the parent/legal guardian making this booking, declare and confirm as follows:
17.1 I understand the dangers and challenges involved in the event booked by me, including the outdoor trails, streams, waterfalls, and other inherent risks described in Clause 4 above.
17.2 I confirm that I have read and understood Clauses 3.6 to 3.10 above regarding disclosure of medical conditions to the trek leader and on the Company's website/app, the requirement to furnish a fitness certificate where applicable, the trek leader's right to conduct further tests, and the consent form required where the participant wishes to proceed despite such tests, and I agree to be bound by them.
17.3 I voluntarily permit my child, and any accompanying family member(s) named in my booking, to participate in the activities organized by Jungle Cubs and Hiking Cubs.
17.4 I confirm that my child, and all accompanying family members, are medically and physically fit to participate, and we agree to strictly follow the safety guidelines and instructions issued by the trek hosts/guides at all times.
17.5 In the event of any accident, injury, illness, disability, loss, damage, or unforeseen incident, neither I, my child, any accompanying family member, nor our respective legal heirs shall hold Jungle Cubs or Hiking Cubs responsible, except in cases of proven wilful negligence on the part of the Company. I confirm that I have read and understood Clause 5.5 (Cost of Treatment and Assistance), Clause 5.6 (Medical Consent Authorisation), Clause 4.1 (Trail Deviation), and Clause 4.2 (Stream Crossing) above, and agree to bear all costs referred to therein and to grant the authorisation described in Clause 5.6. I confirm that I have read and understood Clause 11.1 (Indemnity) above and agree to indemnify the Company as set out therein. I further confirm that I have read and understood Clause 7.1 (Conduct) and Clause 7.2 (Cost of Return on Removal) above, and agree, on my own behalf and on behalf of any accompanying family member, to abide by the conduct requirements and bear the costs referred to therein.
17.6 I confirm that all trek/event fees paid are non-refundable and non-transferable except as provided in Clause 10.1 (25% refund on Company-initiated weather/natural-calamity cancellation prior to commencement of the trek) and Clause 10.2 (full 100% refund on Company-initiated cancellation for personal/internal reasons). I further confirm that I have read and understood Clause 10.3 (no refund where the Company cancels/discontinues the trek due to weather or natural calamities/force majeure reasons after commencement of the trek) and agree to be bound by it, and that no carry-forward of fees applies under Clause 10.1, 10.2, or 10.3, and that I have read, understood, and accepted the Cancellation & Refund Policy (Clause 9) and the food/catering payment obligation for accompanying persons/drivers (Clause 9.4) set out above.
17.7 I confirm that I have carefully read, understood, and accepted all terms and conditions set out in this Participant Agreement.
